- Acceptance of Terms and Conditions
By accessing, browsing or using in any way the Audacityland.com web site (hereinafter referred to as the “Site”), including all pages and services accessible through it, the user (hereinafter referred to as the “User”) agrees to comply with and be bound by these Terms and Conditions (“Terms”), as well as by any laws and regulations applicable to the Site and its use. These Terms constitute a binding agreement between the User and De Rigo Vision Spa, governing access to and use of the Site. In addition, when the User uses particular services provided through the Site, the User shall be subject to the guidelines, terms and agreements applicable to such services. If these Terms conflict with any specific guidelines, terms or agreements, the latter shall prevail.
Participation in the sweepstakes promoted through the Site is conditional upon acceptance of the specific terms and conditions of the contest, which are made available at the dedicated address. These additional terms are deemed to be incorporated into these Terms by reference and form an integral part thereof.
It is your responsibility to review these Terms periodically to be aware of any changes. Your continued use of the Site after such changes will constitute acceptance of the modified Terms. If you do not agree to be bound by or accept these Terms, you are not permitted to access or use the Site in any way.
- Community Token Creation and Responsibility
By creating a community token through the Site, you acknowledge and agree that such token will be immutable and will be held within the Site’s custodial wallet.
The user assumes full responsibility for all data and information entered during the token creation process, including the selection of the token name, associated descriptions and any other relevant data. The user agrees to avoid the use of offensive, inappropriate or otherwise harmful language.
In the event of the posting of content deemed inappropriate or offensive, De Rigo Vision Spa distances itself from any liability relating to user-generated content.
- Exemption from Liability
The user expressly understands and accepts that the use of the services offered by the Site, including the participation in contests, the accumulation of points and the use of QR codes, is at his/her own risk. The user exonerates De Rigo Vision Spa and its affiliates from any liability for any loss of points, errors, technical malfunctions of QR codes, network interruptions or other technical failures that may prevent access to or use of the services of the Site. De Rigo Vision Spa undertakes to take all technically possible and reasonable steps to prevent or solve such problems in a timely manner. However, De Rigo Vision Spa does not guarantee the immediate resolution of such problems and declines any responsibility for any delay or failure to resolve problems that may affect the user’s experience on the Site.
The company is committed to maintaining a level of service that meets users’ expectations, adopting industry best practices to ensure security, reliability and continuity of service. Nevertheless, the user acknowledges that the technology may have unforeseen limitations and malfunctions and that, therefore, the full functionality of the service cannot be guaranteed at all times.
- Limitation of Warranty
De Rigo Vision Spa and its affiliates are committed to providing their services on a “best efforts” basis, which means that all reasonable efforts shall be used to ensure the availability, reliability and functionality of the services offered through the Site. However, due to the unpredictable nature of technology and the Internet, De Rigo Vision Spa and its affiliates cannot guarantee that the service will be uninterrupted, timely, secure, or error-free at all times.
We acknowledge that interruptions may occur due to planned maintenance, upgrades, technical problems beyond our control, or unforeseen events that may cause temporary malfunctions or loss of data. In such circumstances, De Rigo Vision Spa and its affiliates shall endeavour to restore the service as soon as possible, but shall not be liable for any direct or indirect loss or damage suffered by users as a result of such interruptions or malfunctions.
Users acknowledge and agree that use of the services provided by De Rigo Vision Spa and its affiliates is at their own risk. De Rigo Vision Spa and its affiliates expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.
You understand and agree that any material downloaded or otherwise obtained through the use of the services of De Rigo Vision Spa and its affiliates is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
- Limitation of Damages
In no event shall De Rigo Vision Spa or its affiliates be liable for any damages whatsoever arising out of the use or inability to use the points accumulated on the Site, the QR or any other functionality. This limitation of liability includes, without limitation, direct, indirect, incidental, special, exemplary or consequential damages, such as lost profits, business interruption, loss of business information or other pecuniary loss, even if De Rigo Vision Spa or its affiliates have been advised of the possibility of such damages in advance. You acknowledge that the points offered through the Site are intended as an additional, voluntary reward system, and do not constitute a vested right to receive monetary or other value. The liability of De Rigo Vision Spa and its affiliates shall be limited to the maximum extent permitted by applicable law, and in no event shall indemnification exceed the value of points actually lost or malfunctions directly attributable to the actions of De Rigo Vision Spa and its affiliates.
- Regulation of Referrals
You acknowledge that you take full responsibility for the use of the referral system provided by the Site. In particular, you agree to share your referral codes or links only with people who you believe are genuinely interested in the services offered by the Site. It is expressly forbidden to use the referral system for spamming activities or other practices considered unfair or harassing, including the indiscriminate dissemination of referral codes or links through unsolicited or inappropriate channels.
You agree to communicate the details of the referral program in a transparent and honest manner, without misleading potential referrers as to the benefits or conditions of the program. De Rigo Vision Spa and its affiliates reserve the right to verify users’ referral practices and, in case of violation of these terms, to apply sanctions that may include suspension or termination of access to the Site and its services, revocation of points earned through the referral system or other measures deemed appropriate.
Furthermore, you agree that De Rigo Vision Spa and its affiliates may monitor the effectiveness and integrity of the referral system, making changes or adjustments as deemed necessary to maintain trust and transparency within the Site community.
- System Requirements and Accessibility
Access to the services offered by De Rigo Vision Spa and its affiliates requires the use of appropriate technological devices, such as smartphones, computers or tablets, and a stable Internet connection. You acknowledge and agree that you are responsible for having such devices and a suitable connection. De Rigo Vision Spa its affiliates do not accept any responsibility for problems in accessing the services due to inadequate, obsolete or incompatible devices, or internet connection difficulties.

The user, by accessing the Site, confirms that he/she understands that uninterrupted access or the absence of errors in the services cannot be guaranteed, given the dependence on external factors such as the quality of his/her equipment and internet connection.
- Points acquisition and participation in activities
The acquisition of points via the Site is considered an extra benefit and not a fundamental right of the user. These points can be used to access benefits, discounts or special offers available exclusively through the Site.
You acknowledge that the collection and use of points is subject to the availability of such offers and the discretion of De Rigo Vision Spa and its affiliates. Consequently, the user accepts that there are no guarantees on the accumulation of a specific number of points or on their availability for specific rewards or benefits. In the event of technical malfunctions, errors in counting points, or other circumstances that may prevent the acquisition, retention or use of points, De Rigo Vision Spa and its affiliates will endeavour to provide a reasonable solution, but you will not be entitled to claim damages, compensation or refunds based on your expectation of accumulation or use of bonus points. You agree that participation in any bonus points program offered by De Rigo Vision Spa and its affiliates is a privilege that enriches your overall experience on the Site, but is not a contractual obligation on De Rigo Vision Spa and its affiliates to confer any specific value or benefit.
- Changes to the Terms
De Rigo Vision Spa and its affiliates reserve the right, at its sole discretion, to modify, alter or otherwise update these Terms at any time.
